High Court Dismisses Edeoga’s Application In Mbah Vs NYSC

High court dismisses Chijioke Edeoga’s Joinder application in the Governor Peter Mbah’s lawsuit against the National Youth Service Corps (NYSC) for alleged misrepresentation of facts on his discharge.

Justice Inyang Ekwo of the Federal High Court in Abuja has dismissed an application by Hon Edeoga, the Labour Party candidate in Enugu State in the March 18 governorship election, seeking to be joined in Governor Peter Mbah’s lawsuit against NYSC for alleged misrepresentation of facts on his discharge certificate.

The court dismissed the joinder application after the applicant withdrew it. It issued a warning against inaccurate reporting of court events in the N20 billion dispute between the governor and the NYSC.

Before parties proceeded to advance pending motions, Justice Ekwo interposed and advised against misleading reporting.

“In this court, I have an open door policy,” he remarked. I have directed my registrars to make any documents required by the media available to them. I’ve always stated that all I seek is accurate reporting of proceedings in this court.

“It is only in this country that some so-called journalists will report lies and get away with it.”

I’m not even saying you should be objective, but you should report the facts as they are, which is why registrars have been working with the media to ensure court procedures are not distorted.

He warned of the dangers of misrepresenting court procedures.

During the hearings, NYSC’s counsel, Aminu Sadauki, informed the court that he had filed a preliminary injunction.

Mr Emeka Ozoani (SAN), Governor Mbah’s counsel, agreed to further time to allow Sadauki to regularise his papers.

As a result, the court deferred the substantive hearing to July 11, 2023.

Shortly after the hearing, a section of the online media that did not cover the proceedings reported that Justice Ekwo refused to grant Mbah’s request for an interlocutory injunction to prevent the NYSC from appearing before the Election Petitions Tribunal to testify about the allegedly forged NYSC certificate he presented to the INEC.

However, the referred-to application was never filed before the court scheduled a definite hearing for July 11.
